Two homeless men seemed almost determined to be arrested on April Fools' Day Tuesday.
They escaped a citizen's arrest for looking into and opening vehicle doors in Sausalito, but weren't so lucky later in the afternoon, a Sausalito police lieutenant said.
David Wheat, 30, and Brent Bates, 24, were released after a citizen declined to place them under arrest for vehicle tampering in the 4000 block of Bridgeway around 1:30 p.m., Lt. Kurtis Skoog said.
Around 3 p.m., Sgt. Thomas George saw the two men leaving Mollie Stone's Market located at 100 Harbor Drive, Skoog said.
One of the men was trying to hide a bottle of alcohol behind his leg, and the market informed police the two men had just stolen three bottles of alcohol, Skoog said.
Police again contacted the men and, based on their statements and security camera footage, arrested them for commercial burglary, Skoog said.
Both men were booked in the Marin County jail under $15,000 bail.
Bates had a non-extraditable arrest warrant issued out of Texas for possession of dangerous drugs, and Wheat was found to be on probation for burglary in San Diego County, Skoog said.
Wheat also had a non-extraditable warrant for embezzlement in North Carolina, Skoog said.
