Man with Multiple DUI’s Kicks in Patrol Car Equipment During Arrest

William David Hynes, 44, of Tiburon was arrested and booked for a DUI Saturday night. While in the CHP patrol car, he kicked in the front passenger seat and broke the Mobile Video and Audio Recording System.

A Tiburon man who displayed “erratic behavior” during an arrest for suspected a DUI Saturday night damaged a California Highway Patrol car while handcuffed and seat belted in the back of the vehicle.

At 7:35 p.m. Marin County Sheriff Deputies pulled over William David Hynes, 44, on Paradise Drive after a community member reported a driver possibly under the influence. Officers handcuffed Hynes to detain him and the California Highway Patrol responded to assist.

Hynes’ driving record showed he was on an active DUI probation out of Marin County, and after seeing signs of intoxication the CHP placed him under arrested for suspected DUI.

As a CHP officer was taking an inventory of Hynes’ car before having it towed, “he heard Hynes become very agitated inside the patrol vehicle,” according to a press release.

The officer saw him slouched down in the back seat with his legs over the front passenger seat.

“Hynes began kicking towards the front of the vehicle and in the process broke the Mobile Video and Audio Recording System (MVARS) system,” according to the release. “As the officer attempted to remove Hynes from the vehicle to further restrain him, Hynes continued kicking the front passenger seat causing its frame to bend.”

Officers took him out of the patrol car and “additional restraints were applied to prevent him from kicking.”

He was transported to Marin County Jail and booked for a misdemeanor DUI, a misdemeanor DUI with blood alcohol content over .08 percent, violation of probation, felony vandalism in excess of $400 in damage, and driving on a license suspended for DUI.

Hynes was previously arrested for DUI charges in 2011 and 2012.
